Terms of service

1. Agreement

These Terms of Service govern your use of valinorwater.com (the "Site") and your purchase of products from Valinor Water, LLC ("Valinor," "we," "us"), a Delaware limited liability company. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site. Our Privacy Policy (valinorwater.com/policies/privacy-policy) describes how we collect and use your information and is incorporated into these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase from the Site.

3. Products and preorders

Products are currently offered on a preorder basis. Your payment method is charged in full at the time of purchase. Estimated ship dates shown on the Site are good-faith projections, not guaranteed delivery dates. You may cancel a preorder at any time before it ships for a full refund, as described in our Refund Policy.

4. Subscriptions

The Valinor filter plan is a recurring subscription: replacement filters are billed and shipped on the cadence shown at checkout (currently $65 every 90 days, beginning after your pitcher ships — your first filter is included with the pitcher). Your payment method is charged automatically at each renewal until you cancel. You can skip, pause, reschedule, or cancel at any time from your account portal, as described in our Subscription & Cancellation Policy. Subscription prices and terms may change with at least 30 days' notice; changes apply only to future renewals.

5. Pricing, errors, and order acceptance

We work hard to keep pricing and product information accurate, but errors happen. We reserve the right to correct errors and to cancel orders arising from them (with a full refund). We may also refuse, cancel (with a full refund), or limit quantities on any order, including orders we reasonably believe are placed for resale or are fraudulent. Promotional pricing (including founding-member pricing) may be changed or withdrawn for future orders at any time; it will never change an order you've already placed.

6. Product use

Valinor products are designed for use with municipally treated tap water or water otherwise known to be microbiologically safe. Do not use with water that is microbiologically unsafe or of unknown quality without adequate disinfection before or after the unit. Valinor products reduce specific contaminants as described on the Site; they do not render unsafe water safe and are not a substitute for professional water remediation. Performance claims reflect independent laboratory testing to the NSF/ANSI standards identified on the Site. Nothing on the Site is medical advice.

7. Accounts

You're responsible for the accuracy of your account information and the security of your login credentials, and for activity under your account. Notify us promptly of any unauthorized use.

8. Intellectual property

The Site and its content — designs, text, images, logos, and trademarks — are the property of Valinor Water, LLC and are protected by law. You may not reproduce or use them without our written permission.

9. Reviews and submitted content

By submitting reviews, photos, or other content to us or the Site, you grant Valinor a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with our products and marketing, and you confirm it's yours and accurate. Nothing in this section limits rights you have under the Consumer Review Fairness Act.

10. Communications

By providing your email address or phone number, you consent to receive transactional and marketing communications from us. You can opt out of marketing at any time via the unsubscribe link (or by replying STOP to texts, if we offer them); message and data rates may apply.

11. Third-party services

The Site may link to third-party sites or rely on third-party services (such as payment processors). We're not responsible for their content or practices.

12. Acceptable use

You agree not to misuse the Site — including interfering with its operation, attempting unauthorized access, scraping at scale, or using it for anything unlawful.

13. Warranties, disclaimers, and limitation of liability

Except as expressly stated in these Terms, our Refund Policy, or elsewhere on the Site, and to the maximum extent permitted by law: the Site and products are provided "as is," and any implied warranties (including merchantability and fitness for a particular purpose) are limited in duration to the length of the applicable express guarantee. Valinor's total liability for any claim arising out of your purchase or use of the Site or products is limited to the amount you paid for the product giving rise to the claim, and we are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; nothing in these Terms limits liability that cannot be limited by law or affects the rights described in our Refund Policy.

14. Force majeure

We're not liable for delays or failures caused by events beyond our reasonable control — natural disasters, supply-chain disruptions, labor disputes, or government action. If such an event delays your preorder, your right to cancel for a full refund before shipment is unaffected.

15. Dispute resolution; class-action waiver

If you have an issue, contact us first — hello@valinorwater.com — and we'll try to resolve it informally within 60 days. Any dispute that can't be resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. For claims of $10,000 or less, Valinor will pay the AAA filing and arbitrator fees unless the arbitrator finds the claim frivolous. You and Valinor each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing hello@valinorwater.com within 30 days of your first purchase. Changes to this section do not apply retroactively to disputes that arose before the change.

16. Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and the parties consent to their jurisdiction.

17. Notice to California residents

Under California Civil Code §1789.3, California users are entitled to know that complaints may be filed with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210. 18. Changes

We may update these Terms from time to time; the "Last updated" date above reflects the current version. Material changes will be posted on the Site, and material changes to subscription terms take effect only at your next renewal. Continued use after changes means you accept them.

19. Severability; entire agreement; assignment

If any provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will stay in effect. These Terms, together with the policies referenced in them, are the entire agreement between you and Valinor regarding the Site and your purchases. We may assign these Terms; you may not assign them without our consent. Our failure to enforce a provision is not a waiver of it.
